Florida Sues Biden Administration Over Immigrant Release

(RepublicanNews.org) – Once again, the state of Florida is fighting the Biden Administration over its approach to massive illegal immigration with a suit by state Attorney General Ashley Moody.

Moody filed suit to seek an injunction that would stop the federal government from releasing thousands of would-be immigrants into the U.S. following the expiration of Title 42 on May 11th. Title 42 is a COVID-era rule used by both Presidents Donald Trump and Joe Biden to quickly expel immigrants on public health grounds. It has been used to turn back 2.8 million immigrants since 2020. 

In court filings, Moody said the Biden Administration’s plan to release into the U.S. any migrants that cannot be housed by Customs and Border Patrol is illegal. Moody argued the current approach is the same one that a federal judge ruled was illegal just two months ago. 

That earlier policy funneled the overflow of migrants into the “Alternatives to Detention” program instead of sending them back to their own countries or turning them away at the border. The judge said the federal government had “turned the Southwest Border into a meaningless line in the sand” that did nothing to stop illegal aliens from entering the country. 

Department of Homeland Security (DHS) Secretary Alejandro Mayorkas has been pleading with immigrants through the press to stop believing that Title 42’s expiration means they will be able to walk into the U.S. That message is not being received, however, as thousands more immigrants than usual amass on the Mexican side of the border in towns like El Paso and Brownsville, Texas. 

Mayorkas’ claims are also at odds with the federal government’s apparent plans. According to Fox News, Washington officials have given Customs and Border Patrol permission to release any immigrants that can’t be held by CBP or nonprofit aid groups, so long as that release is “safe.” It is not clear what the government considers a safe release of thousands of aliens.
